Status: Final Sanction Detail: 30 DAYS Summary: FROM 2000 TO 2009, MR. BOEHM WAS ASSOCIATED WITH CHARLES & CO., INC. ("SCHWAB"), A FINRA REGISTERED BROKER-DEALER. IN 2007, WHILE ASSOCIATED WITH SCHWAB, MR. BOEHM ENTERED INTO A HANDWRITTEN AGREEMENT WITH A CUSTOMER OF THE BROKER-DEALER WHILE AT THE CUSTOMER'S GARAGE SALE. MR. BOEHM AND THE CUSTOMER AGREED TO MR. BOEHM'S PURCHASE OF THREE OLDER VEHICLES AT A DISCOUNTED PRICE FROM THE CUSTOMER IN EXCHANGE FOR THE ADVISORY SERVICES PROVIDED BY MR. BOEHM THROUGH HIS BROKER-DEALER WITHOUT PROVIDING PRIOR WRITTEN NOTICE TO OR SEEKING APPROVAL FROM HIS BROKER-DEALER. AT THE TIME, THE BROKER-DEALER PROHIBITED REPRESENTATIVES FROM CONDUCTING OUTSIDE BUSINESS ACTIVITIES AND ENTERING INTO CUSTOMER AGREEMENTS WITHOUT SEEKING PRIOR WRITTEN NOTICE AND APPROVAL. THROUGH A LETTER OF ACCEPTANCE, WAIVER AND CONSENT (AWC), FINRA AND MR. BOEHM AGREED TO THE SETTLEMENT OF ALLEGATIONS THAT HE VIOLATED NASD RULES 2110 AND 3030 WHEN HE ENTERED INTO THE AGREEMENT AS DESCRIBED ABOVE AND AGREED TO ONE MONTH SUSPENSION FROM ASSOCIATION WITH ALL FINRA MEMBERS (BROKER-DEALERS) AND A $5,000 FINE. SINCE MR. BOEHM'S AFFILIATION WITH KMS, HE HAS OPERATED WITHOUT ANY ADDITIONAL DISCIPLINARY EVENTS.
