Allegations: THE SEC ALLEGED THAT THE PACIFIC FINANCIAL GROUP, INC. ("TPFG"), A REGISTERED INVESTMENT ADVISER, HAD ADVERTISED HYPOTHETICAL PERFORMANCE WITH RESPECT TO ITS INVESTMENT PRODUCTS ON ITS PUBLIC WEBSITE WITHOUT ADOPTING AND IMPLEMENTING APPROPRIATE POLICIES AND PROCEDURES AS REQUIRED UNDER SECTION 206(4) OF THE INVESTMENT ADVISERS ACT AND RULE 206(4)-1 THEREUNDER. Status: Final Sanction Detail: A CIVIL MONEY PENALTY OF $430,000 WAS ASSESSED AGAINST TPFG. THIS PENALTY WAS PAID IN ITS ENTIRETY ON AUGUST 15, 2024. Summary: ON AUGUST 9, 2024, THE SEC ACCEPTED TPFG'S OFFER OF SETTLEMENT FOR ALLEGED VIOLATIONS OF SECTION 206(4) OF THE INVESTMENT ADVISERS ACT OF 1940 AND RULE 206(4)-1 THEREUNDER. THE SEC FOUND THAT FROM NOVEMBER 4, 2022 THROUGH DECEMBER 15, 2023, TPFG HAD ADVERTISED HYPOTHETICAL PERFORMANCE FOR A NUMBER OF PORTFOLIOS WITHOUT HAVING THE REQUISITE POLICIES AND PROCEDURES IN PLACE. WITHOUT ADMITTING OR DENYING THE SEC'S ALLEGATIONS, TPFG CONSENTED TO A CENSURE, A CEASE-AND-DESIST ORDER TO COMPLY WITH UNDERTAKINGS NOT TO ADVERTISE HYPOTHETICAL PERFORMANCE WITHOUT HAVING THE REQUISITE POLICIES AND PROCEDURES IN PLACE, AND A CIVIL PENALTY OF $430,000 WHICH WAS PAID ON AUGUST 15, 2024.
