UNDER SECTIONS 1053 AND 1056 OF THE CFPA, 12 U.S.C. §§ 5563, 5565. Status: Final Sanction Detail: FIFTH THIRD BANK TO PAY A CIVIL MONEY PENALTY OF FIVE HUNDRED THOUSAND DOLLARS TO THE CFPB. Allegations: THE CFPB CONDUCTED A JOINT INVESTIGATION WITH THE CIVIL RIGHTS DIVISION OF THE DOJ OF THE INDIRECT AUTO LENDING ACTIVITIES OF FIFTH THIRD BANK AND FIFTH THIRD BANK'S COMPLIANCE WITH THE EQUAL CREDIT OPPORTUNITY ACT (ECOA), 15 U.S.C. §§ 16911691F, AND ITS IMPLEMENTING REGULATION, REGULATION B, 12 C.F.R. PT. 1002. THE CFPB HAS IDENTIFIED THE FOLLOWING VIOLATIONS: FIFTH THIRD BANK VIOLATED THE ECOA AND REGULATION B BY PERMITTING DEALERS TO CHARGE HIGHER INTEREST RATES TO CONSUMER AUTO LOAN BORROWERS ON THE BASIS OF RACE AND NATIONAL ORIGIN. THE DOJ HAS ALLEGED THE SAME VIOLATIONS IN A CIVIL ACTION FILED IN THE UNITED STATES DISTRICT COURT FOR THE SOUTHERN DISTRICT OF OHIO STYLED UNITED STATES OF AMERICA V. FIFTH THIRD BANK, FILED ON OR ABOUT SEPTEMBER 28, 2015. THE CFPB HEREBY ISSUES, PURSUANT TO SECTIONS 1053 AND 1055 OF THE CONSUMER FINANCIAL PROTECTION ACT OF 2010 (CFPA), 12 U.S.C. §§ 5563, 5565, THIS CONSENT ORDER IN COORDINATION WITH THE DOJ. Status: Final Sanction Detail: FIFTH THIRD BANK IS REQUIRED TO PAY $18 MILLION (EIGHTEEN MILLION DOLLARS) IN REDRESS TO AFFECTED CONSUMERS WHO WERE OVERCHARGED. FIFTH THIRD BANK SHALL RECEIVE A CREDIT OF NO LESS THAN $5 MILLION (FIVE MILLION DOLLARS) AND NO MORE THAN $6 MILLION (SIX MILLION DOLLARS) FOR REMEDIATION IT HAS ALREADY PROVIDED TO AFFECTED CONSUMERS.
