Disciplinary disclosures
Allegations: IN HIS SECOND AMENDED COMPLAINT FILED IN JUNE 2023, PLAINTIFF, A SOPHISTICATED REAL ESTATE LAWYER AND REGISTERED PATENT ATTORNEY, SOUGHT DAMAGES OF $232,722 AGAINST SEVERAL DEFENDANTS FOR VARIOUS CAUSES OF ACTION INVOLVING LOSSES IN FOREIGN EXCHANGE TRADING IN FEBRUARY 2018. PLAINTIFF ALLEGED THAT HCM WAS NEGLIGENT. THE PLAINTIFF WAS NEITHER A CLIENT OF HULICK CAPITAL MANAGEMENT, LLC ("HCM") NOR ANY OF ITS INVESTMENT ADVISERS. IN FEBRUARY 2018, THE PLAINTIFF OPENED AN ACCOUNT WITH THE CO-DEFENDANT BOLOUR AS HIS TRADING ADVISER AT OANDA CORPORATION, A CO-DEFENDANT, TO INVEST IN FOREIGN CURRENCY ALLEGEDLY DUE, IN PART, ON HIS RELIANCE ON INFORMATION PROVIDED TO HIM BY CO-DEFENDANT RODAL AND ON E-MAIL COMMUNICATIONS ABOUT FOREIGN CURRENCY PREVIOUSLY SENT BY CO-DEFENDANT COLON FROM HIS OWN EMAIL ADDRESS. Status: Pending Summary: THE PLAINTIFF NEVER HAD ANY CLIENT RELATIONSHIP WITH HCM NOR ANY OF ITS ADVISORY AFFILIATES. THE SUBJECT E-MAIL COMMUNICATIONS, WHICH OCCURRED BETWEEN 2014-JULY 2017 CAME FROM AN E-MAIL ADDRESS THAT HAD NO AFFILIATION OR CONNECTION WITH HCM, AND THEY WERE SENT WITHOUT PRIOR KNOWLEDGE OF OR AUTHORIZATION BY HCM. IN THE SECOND AMENDED COMPLAINT, PLAINTIFF ALLEGED ONLY NEGLIGENCE AND NEGLIGENT SUPERVISION BY HCM. ALL THE REMAINING COUNTS WERE AGAINST THE CO-DEFENDANTS. HCM ADAMANTLY DENIES THE ALLEGATIONS AND BELIEVES THAT IT HAS GOOD DEFENSES TO THE ACTION.
